Such information may be abbreviated in so far as the abbreviation makes it possible to identify that person and his address. If several addresses are indicated, the one where the responsible person makes readily available the product information file shall be highlighted.<\/p>\n<p>The country of origin shall be specified for imported cosmetic products.[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=&#8221;Why should we conduct a Challenge test?&#8221;]<div class=\"standard-arrow bullet-top\"><p>The Challenge test is mandatory for all cosmetic products, according to Regulation EC 1223\/2009. Challenge test is essential to justify the effectiveness of the preservation system and justify the shelf life and period after opening of cosmetics in terms of safety.<\/p>\n<p>Water-based cosmetic products provide a perfect environment for microbial growth, and the products\u2019 additional components can serve as nutrients for these microorganisms. It should be kept in mind that a contaminated product (which may show no visible signs of contamination) is much more dangerous for users than preservatives.<\/p>\n<p>The reasons for microbial preservation of cosmetics are:<\/p>\n<ul>\n<li>to ensure the microbial safety for the consumers<\/li>\n<li>to maintain the intended quality and specifications<\/li>\n<li>to preserve the image and the reputation of your company<\/li>\n<\/ul>\n<\/div>[\/vc_accordion_tab][vc_accordion_tab title=&#8221;When should the Durability be indicated and when the PAO (Period After Opening)?&#8221;][vc_column_text]The indication of the Durability Date is obligatory for all cosmetic products which the minimum durability date does not exceed the 30 months.<\/p>\n<p>For cosmetic products which the minimum durability date exceed the 30 months an indication of the time after opening the package in which the product can be used without endangering the health of consumers, is called PAO.<\/p>\n<p>For single use products\u00a0the\u00a0indication of\u00a0PAO is not obligatory.[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=&#8221;What is withdrawal and recall of a cosmetic product?&#8221;][vc_column_text]Withdrawal means any measure aimed at preventing the making available on the market of a cosmetic product in the supply chain.<\/p>\n<p>Recall means any measure aimed at achieving the return of a cosmetic product that has already been made available to the end user.[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=&#8221;What are the obligations of the distributor?&#8221;]<div class=\"standard-arrow bullet-top\"><p>\u2018Distributor\u2019 means any natural or legal person in the supply chain, other than the manufacturer or the importer, who makes a cosmetic product available on the Community market. This includes wholesalers, retailers, shops, beauty or hair salons, telesales, outlets and internet selling.<\/p>\n<p>Before making a cosmetic product available on the market distributors shall verify that:<\/p>\n<ul>\n<li>The mandatory labeling information is present.<\/li>\n<li>The language requirements are fulfilled.<\/li>\n<li>The date of minimum durability specified, where applicable, has not passed.<\/li>\n<li>Distributors shall ensure that, while a product is under their responsibility, storage or transport conditions do not jeopardize its compliance with the requirements set out in the Cosmetics Regulation.<\/li>\n<\/ul>\n<p>Where distributors consider or have reason to believe that:<\/p>\n<p>A cosmetic product is not in conformity with the requirements laid down in the Cosmetics Regulation, they shall not make the product available on the market until it has been brought into conformity with the applicable requirements.<\/p>\n<\/div>[\/vc_accordion_tab][vc_accordion_tab title=&#8221;Do products containing only natural ingredients need a Safety Assessment?&#8221;][vc_column_text]A safety assessment is required for <u>all cosmetic products<\/u>, regardless of the origin of the materials they contain. It does not matter whether a cosmetic product is made up of all natural or all synthetic ingredients &#8211; the legislation does not distinguish between the origins of an ingredient.<\/p>\n<p>Whether an ingredient is synthetic or natural has no bearing on whether an ingredient is safe to use. The Annexes of the EU Cosmetics Regulations include many natural materials, as well as many man-made materials, that are prohibited from use in cosmetics for reasons of safety.[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=&#8221;Is my product vegan?&#8221;][vc_column_text]There is no legal definition of a vegan cosmetic product. Responsible persons may include claims that the product does not contain any animal-derived ingredients or is &#8216;suitable for vegans&#8217;. Such claims are acceptable, but it is a legal requirement that all claims can be substantiated and are not misleading to the consumer. It should therefore be clear to the consumer what criteria are being applied.<\/p>\n<p>It must be remembered that certification by a commercial organization of either ingredients and\/or a final cosmetic product is optional, while compliance with the EU Cosmetics Regulations is mandatory.[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=&#8221;Does my product labeling have to be reviewed or approved?&#8221;][vc_column_text]There is no legal requirement for labeling to be reviewed or approved by a third party.<\/p>\n<p>However, as mistakes can be costly to rectify and can have a reputational impact, it is recommended that the artwork is checked by a specialist experienced with the EU Cosmetics Regulation.[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=&#8221;What information needs to be printed on the label of a cosmetic product?&#8221;][vc_column_text]The labeling requirements for cosmetic products are detailed under Article 19 of the EU Cosmetics Regulation.<\/p>\n<p>The container and packaging of cosmetic products should bear the following information in indelible, easily legible and visible lettering<\/p>\n<ol>\n<li>Name and address of the EU Responsible Person.<\/li>\n<li>The nominal content at the time of packaging, given by weight or by volume<\/li>\n<li>Period after Opening or date of minimum durability where relevant<\/li>\n<li>Warning statements and precautionary information;<\/li>\n<li>The batch number of manufacture<\/li>\n<li>The function of the cosmetic product, unless it is clear from its presentation<\/li>\n<li>Declaration of ingredients. The list shall be preceded by the term \u2018ingredients\u2019<\/li>\n<li>Country of origin for imported products.<\/li>\n<\/ol>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=&#8221;Do I need a Responsible Person in the EU?&#8221;][vc_column_text css=&#8221;&#8221;]<\/p>\n<p data-start=\"320\" data-end=\"463\"><strong data-start=\"320\" data-end=\"328\">Yes.<\/strong><br data-start=\"328\" data-end=\"331\" \/>Every cosmetic product placed on the EU market <strong data-start=\"378\" data-end=\"462\">must have a designated Responsible Person (RP) established in the European Union<\/strong>.<\/p>\n<h3 data-start=\"465\" data-end=\"503\">Who can be the Responsible Person?<\/h3>\n<p data-start=\"504\" data-end=\"518\">The RP can be:<\/p>\n<ul data-start=\"519\" data-end=\"711\">\n<li data-start=\"519\" data-end=\"550\">\n<p data-start=\"521\" data-end=\"550\">The <strong data-start=\"525\" data-end=\"544\">EU manufacturer<\/strong>, or<\/p>\n<\/li>\n<li data-start=\"551\" data-end=\"618\">\n<p data-start=\"553\" data-end=\"618\">The <strong data-start=\"557\" data-end=\"569\">importer<\/strong> (for products manufactured outside the EU), or<\/p>\n<\/li>\n<li data-start=\"619\" data-end=\"711\">\n<p data-start=\"621\" data-end=\"711\">A <strong data-start=\"623\" data-end=\"660\">third party established in the EU<\/strong>, formally appointed in writing by the brand owner.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"713\" data-end=\"768\">What are the obligations of the Responsible Person?<\/h3>\n<p data-start=\"769\" data-end=\"854\">The Responsible Person is legally responsible for ensuring that the cosmetic product:<\/p>\n<ul data-start=\"855\" data-end=\"1301\">\n<li data-start=\"855\" data-end=\"906\">\n<p data-start=\"857\" data-end=\"906\">Complies with <strong data-start=\"871\" data-end=\"906\">EU Regulation (EC) No 1223\/2009<\/strong><\/p>\n<\/li>\n<li data-start=\"907\" data-end=\"965\">\n<p data-start=\"909\" data-end=\"965\">Has a <strong data-start=\"915\" data-end=\"956\">Cosmetic Product Safety Report (CPSR)<\/strong> in place<\/p>\n<\/li>\n<li data-start=\"966\" data-end=\"1032\">\n<p data-start=\"968\" data-end=\"1032\">Has a complete and up-to-date <strong data-start=\"998\" data-end=\"1032\">Product Information File (PIF)<\/strong><\/p>\n<\/li>\n<li data-start=\"1033\" data-end=\"1096\">\n<p data-start=\"1035\" data-end=\"1096\">Is <strong data-start=\"1038\" data-end=\"1062\">notified in the CPNP<\/strong> before being placed on the market<\/p>\n<\/li>\n<li data-start=\"1097\" data-end=\"1161\">\n<p data-start=\"1099\" data-end=\"1161\">Is <strong data-start=\"1102\" data-end=\"1123\">properly labelled<\/strong> and compliant with claims legislation<\/p>\n<\/li>\n<li data-start=\"1162\" data-end=\"1301\">\n<p data-start=\"1164\" data-end=\"1301\">Is subject to <strong data-start=\"1178\" data-end=\"1209\">correct market surveillance<\/strong>, including cooperation with authorities in case of inspections, recalls, or adverse effects<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"1303\" data-end=\"1332\">What about non-EU brands?<\/h3>\n<p data-start=\"1333\" data-end=\"1507\">Non-EU manufacturers <strong data-start=\"1354\" data-end=\"1402\">cannot act as Responsible Persons themselves<\/strong>.<br data-start=\"1403\" data-end=\"1406\" \/>They must appoint an <strong data-start=\"1427\" data-end=\"1458\">EU-based Responsible Person<\/strong> before importing or selling cosmetics in the EU.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=&#8221;When is CPNP notification mandatory and who is responsible for it?&#8221;][vc_column_text css=&#8221;&#8221;]<\/p>\n<p data-start=\"1587\" data-end=\"1675\"><strong data-start=\"1587\" data-end=\"1675\">CPNP notification is mandatory before a cosmetic product is placed on the EU market.<\/strong><\/p>\n<p data-start=\"1677\" data-end=\"1776\">This means <strong data-start=\"1688\" data-end=\"1744\">before the product is sold, distributed, or supplied<\/strong>, whether free of charge or not.<\/p>\n<h3 data-start=\"1778\" data-end=\"1827\">Who is responsible for the CPNP notification?<\/h3>\n<p data-start=\"1828\" data-end=\"1966\">The <strong data-start=\"1832\" data-end=\"1854\">Responsible Person<\/strong> is legally responsible for submitting the notification in the <strong data-start=\"1917\" data-end=\"1965\">Cosmetic Products Notification Portal (CPNP)<\/strong>.<\/p>\n<h3 data-start=\"1968\" data-end=\"2014\">What information is submitted to the CPNP?<\/h3>\n<p data-start=\"2015\" data-end=\"2055\">The notification includes, among others:<\/p>\n<ul data-start=\"2056\" data-end=\"2250\">\n<li data-start=\"2056\" data-end=\"2083\">\n<p data-start=\"2058\" data-end=\"2083\">Product name and category<\/p>\n<\/li>\n<li data-start=\"2084\" data-end=\"2112\">\n<p data-start=\"2086\" data-end=\"2112\">Responsible Person details<\/p>\n<\/li>\n<li data-start=\"2113\" data-end=\"2137\">\n<p data-start=\"2115\" data-end=\"2137\">Country of manufacture<\/p>\n<\/li>\n<li data-start=\"2138\" data-end=\"2181\">\n<p data-start=\"2140\" data-end=\"2181\">Presence of nanomaterials (if applicable)<\/p>\n<\/li>\n<li data-start=\"2182\" data-end=\"2197\">\n<p data-start=\"2184\" data-end=\"2197\">Label artwork<\/p>\n<\/li>\n<li data-start=\"2198\" data-end=\"2250\">\n<p data-start=\"2200\" data-end=\"2250\">Formula framework information (for poison centres)<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2200\" data-end=\"2250\"><strong data-start=\"2255\" data-end=\"2269\">Important:<\/strong><br data-start=\"2269\" data-end=\"2272\" \/>CPNP notification is <strong data-start=\"2293\" data-end=\"2320\">not an approval process<\/strong>. Authorities do not \u201capprove\u201d products in advance, but incorrect or missing notification can lead to enforcement actions.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=&#8221;How often does a CPSR need to be updated?&#8221;][vc_column_text css=&#8221;&#8221;]<\/p>\n<p data-start=\"2497\" data-end=\"2639\">A Cosmetic Product Safety Report (CPSR) <strong data-start=\"2537\" data-end=\"2567\">is not a one-time document<\/strong>.<br data-start=\"2568\" data-end=\"2571\" \/>It must be <strong data-start=\"2582\" data-end=\"2638\">reviewed and updated whenever relevant changes occur<\/strong>.<\/p>\n<h3 data-start=\"2641\" data-end=\"2676\">A CPSR update is required when:<\/h3>\n<ul data-start=\"2677\" data-end=\"3147\">\n<li data-start=\"2677\" data-end=\"2776\">\n<p data-start=\"2679\" data-end=\"2776\"><strong data-start=\"2679\" data-end=\"2702\">The formula changes<\/strong><br data-start=\"2702\" data-end=\"2705\" \/>(new ingredient, concentration change, replacement of a raw material)<\/p>\n<\/li>\n<li data-start=\"2777\" data-end=\"2885\">\n<p data-start=\"2779\" data-end=\"2885\"><strong data-start=\"2779\" data-end=\"2831\">A supplier or raw-material specification changes<\/strong><br data-start=\"2831\" data-end=\"2834\" \/>(new impurity profile, new manufacturing process)<\/p>\n<\/li>\n<li data-start=\"2886\" data-end=\"2988\">\n<p data-start=\"2888\" data-end=\"2988\"><strong data-start=\"2888\" data-end=\"2922\">Regulatory requirements change<\/strong><br data-start=\"2922\" data-end=\"2925\" \/>(new ingredient restrictions, bans, or labelling obligations)<\/p>\n<\/li>\n<li data-start=\"2989\" data-end=\"3045\">\n<p data-start=\"2991\" data-end=\"3045\"><strong data-start=\"2991\" data-end=\"3045\">New safety or toxicological data becomes available<\/strong><\/p>\n<\/li>\n<li data-start=\"3046\" data-end=\"3147\">\n<p data-start=\"3048\" data-end=\"3147\"><strong data-start=\"3048\" data-end=\"3075\">The product use changes<\/strong><br data-start=\"3075\" data-end=\"3078\" \/>(e.g. from rinse-off to leave-on, children\u2019s use, professional use)<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"3149\" data-end=\"3186\">Is there a fixed validity period?<\/h3>\n<p data-start=\"3187\" data-end=\"3317\">No fixed expiry date exists.<br data-start=\"3215\" data-end=\"3218\" \/>However, the CPSR must <strong data-start=\"3241\" data-end=\"3316\">always reflect the current formula and the current regulatory framework<\/strong>.<\/p>\n<p data-start=\"3319\" data-end=\"3503\"><strong>Best practice:<\/strong><br data-start=\"3336\" data-end=\"3339\" \/>A CPSR should be <strong data-start=\"3356\" data-end=\"3381\">periodically reviewed<\/strong>, especially in times of major regulatory updates (e.g. fragrance allergens, microplastics, ingredient reclassifications).<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=&#8221;Are \u201cnatural\u201d or \u201corganic\u201d cosmetics exempt from EU legislation?&#8221;][vc_column_text css=&#8221;&#8221;]<\/p>\n<p data-start=\"204\" data-end=\"316\"><strong data-start=\"204\" data-end=\"211\">No.<\/strong><br data-start=\"211\" data-end=\"214\" \/>Cosmetic products marketed as <strong data-start=\"244\" data-end=\"315\">\u201cnatural\u201d or \u201corganic\u201d are not exempt from EU cosmetics legislation<\/strong>.<\/p>\n<p data-start=\"318\" data-end=\"488\">All cosmetic products placed on the EU market \u2014 regardless of their origin, positioning, or marketing claims \u2014 must fully comply with <strong data-start=\"452\" data-end=\"487\">EU Regulation (EC) No 1223\/2009<\/strong>.<\/p>\n<h3 data-start=\"490\" data-end=\"526\">What does this mean in practice?<\/h3>\n<p data-start=\"527\" data-end=\"565\">\u201cNatural\u201d or \u201corganic\u201d cosmetics must:<\/p>\n<ul data-start=\"566\" data-end=\"866\">\n<li data-start=\"566\" data-end=\"616\">\n<p data-start=\"568\" data-end=\"616\">Have a <strong data-start=\"575\" data-end=\"616\">Cosmetic Product Safety Report (CPSR)<\/strong><\/p>\n<\/li>\n<li data-start=\"617\" data-end=\"695\">\n<p data-start=\"619\" data-end=\"695\">Be assessed for <strong data-start=\"635\" data-end=\"659\">toxicological safety<\/strong>, including impurities and allergens<\/p>\n<\/li>\n<li data-start=\"696\" data-end=\"746\">\n<p data-start=\"698\" data-end=\"746\">Comply with <strong data-start=\"710\" data-end=\"746\">ingredient restrictions and bans<\/strong><\/p>\n<\/li>\n<li data-start=\"747\" data-end=\"790\">\n<p data-start=\"749\" data-end=\"790\">Meet <strong data-start=\"754\" data-end=\"790\">labeling and claims requirements<\/strong><\/p>\n<\/li>\n<li data-start=\"791\" natural ingredients mean automatic safety?<\/h3>\n<p data-start=\"918\" data-end=\"966\">No.<br data-start=\"921\" data-end=\"924\" \/>Natural and organic ingredients may still:<\/p>\n<ul data-start=\"967\" data-end=\"1097\">\n<li data-start=\"967\" data-end=\"1011\">\n<p data-start=\"969\" data-end=\"1011\">Cause <strong data-start=\"975\" data-end=\"1011\">skin irritation or sensitisation<\/strong><\/p>\n<\/li>\n<li data-start=\"1012\" data-end=\"1043\">\n<p data-start=\"1014\" data-end=\"1043\">Contain <strong data-start=\"1022\" data-end=\"1043\">natural allergens<\/strong><\/p>\n<\/li>\n<li data-start=\"1044\" data-end=\"1097\">\n<p data-start=\"1046\" data-end=\"1097\">Have <strong data-start=\"1051\" data-end=\"1097\">usage restrictions or concentration limits<\/strong><\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1099\" data-end=\"1241\">For example, essential oils and plant extracts are subject to the <strong data-start=\"1165\" data-end=\"1215\">same safety evaluation and regulatory controls<\/strong> as synthetic ingredients.<\/p>\n<h3 data-start=\"1243\" data-end=\"1282\">What about \u201corganic\u201d certification?<\/h3>\n<p data-start=\"1283\" data-end=\"1447\">Terms such as <em data-start=\"1297\" data-end=\"1308\">\u201corganic\u201d<\/em> or <em data-start=\"1312\" data-end=\"1323\">\u201cnatural\u201d<\/em> refer to <strong data-start=\"1333\" data-end=\"1366\">private certification schemes<\/strong> (e.g. COSMOS, ECOCERT) and <strong data-start=\"1394\" data-end=\"1446\">do not replace or override EU legal requirements<\/strong>.<\/p>\n<p data-start=\"1449\" data-end=\"1550\">Compliance with EU cosmetics legislation is <strong data-start=\"1493\" data-end=\"1506\">mandatory<\/strong>, regardless of any voluntary certification.<\/p>\n<p>[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=&#8221;Who is legally responsible for marketing claims on a cosmetic product?&#8221;][vc_column_text css=&#8221;&#8221;]<\/p>\n<p data-start=\"201\" data-end=\"353\">The <strong data-start=\"205\" data-end=\"232\">Responsible Person (RP)<\/strong> is <strong data-start=\"236\" data-end=\"259\">legally responsible<\/strong> for all marketing and advertising claims made for a cosmetic product placed on the EU market.<\/p>\n<p data-start=\"355\" data-end=\"389\">This includes claims appearing on:<\/p>\n<ul data-start=\"390\" data-end=\"524\">\n<li data-start=\"390\" data-end=\"410\">\n<p data-start=\"392\" data-end=\"410\">Product <strong data-start=\"400\" data-end=\"410\">labels<\/strong><\/p>\n<\/li>\n<li data-start=\"411\" data-end=\"426\">\n<p data-start=\"413\" data-end=\"426\"><strong data-start=\"413\" data-end=\"426\">Packaging<\/strong><\/p>\n<\/li>\n<li data-start=\"427\" data-end=\"453\">\n<p data-start=\"429\" data-end=\"453\"><strong data-start=\"429\" data-end=\"453\">Websites and e-shops<\/strong><\/p>\n<\/li>\n<li data-start=\"454\" data-end=\"472\">\n<p data-start=\"456\" data-end=\"472\"><strong data-start=\"456\" data-end=\"472\">Social media<\/strong><\/p>\n<\/li>\n<li legal responsibility mean?<\/h3>\n<p data-start=\"567\" data-end=\"618\">The Responsible Person must ensure that all claims:<\/p>\n<ul data-start=\"619\" data-end=\"878\">\n<li data-start=\"619\" data-end=\"668\">\n<p data-start=\"621\" data-end=\"668\">Comply with <strong data-start=\"633\" data-end=\"668\">EU Regulation (EC) No 1223\/2009<\/strong><\/p>\n<\/li>\n<li data-start=\"669\"
