The European Commission has published the draft document for the 18th Adaptation to Technical Progress (ATP) to Regulation (EC) 1272/2008 of the CLP Regulation.

Part 3 of Annex VI of the CLP regulation has been amended with the addition of harmonized classification and labeling for 39 new substances, the modification for 17 substances and the deletion of one substance.

Some cosmetic ingredients will be affected due to their hazardous harmonized classification.

CMR substances of category 1, under Part 3 of Annex VI to Regulation (EC) No 1272/2008, shall be directly prohibited.

CMR substances of category 2, shall be either directly prohibited or may be allowed where the substance has been evaluated by the SCCS and found safe for use in cosmetic products.

The Annexes of the Cosmetics Regulation should soon be modified in light of the recent classification of all of them by an “Omnibus” regulation.

The cosmetic ingredients affected are:

  • Azadirachta Extracts (from the kernels of Azadirachta Indica, extracted with water and further processed with organic solvents) (CAS no 84696-25-3): Repr. 2, Skin Sens. 1 and Aquatic Chronic 1
  • Benzophenone (CAS no 119-61-9): Carc. 1B
  • Butoxyethanol (CAS no 111-76-2): Acute Tox. 3, Acute Tox. 4, Skin Irrit. 2, and Eye Irrit. 2
  • Isobornyl Acrylate (CAS no 5888-33-5): Skin Sens. 1A
  • Melamine (CAS no 108-78-1): Carc. 2 and STOT SE 2
  • Pentasodium Pentetate
  • Pentetic Acid (CAS no 67-43-6): Repr. 1B, Acute Tox. 4, STOT RE 2 and Eye Irrit. 2
  • Phenylpropane (CAS no 103-65-1): Flam. Liq. 3, Asp. Tox. 1, STOT SE 3, and Aquatic Chronic 2
  • Piperonyl Butoxide (CAS no 51-03-6): STOT SE 3, Eye Irrit. 2, Aquatic Acute 1 and Aquatic Chronic 1
  • Theophylline (CAS no 58-55-9): Repr. 1B
  • Trimethylolpropane triacrylate (CAS no 15625-89-5): Carc. 2, Skin Irrit. 2, Eye Irrit. 2, Skin Sens. 1, Aquatic Acute 1, Aquatic Chronic 1
  • Xylene Diisocyanate (CAS no 3634-83-1): Resp. Sens. 1 and Skin Sens. 1A (CAS no 140-01-2): Repr. 1B, Acute Tox. 4 and STOT RE 2

The 18th ATP, as well as the forthcoming provisions amending the REACH and Cosmetics Regulations, will apply from the same date: 1 December 2023.
